On 29 September 2026, the European Commission opened a targeted consultation on copyright in the AI era (open until 3 November), covering not only model training but also inference (including RAG systems) and generated outputs, and putting up for discussion opt-out standards, traceability, audits, collective licences and even a rebuttable presumption of use. On 30 September, ESMA published its response to the MiCA review consultation, proposing to frame the CASPs serving as gateways to DeFi, to clarify staking and crypto-lending, and to strengthen its own supervisory powers. The weak signal: regulation no longer stops at the product; it is moving up towards infrastructures and value chains.
